He died in January 1742 in Essex Co., VA.¹ He signed a will on 15 January 1742 in Essex Co., VA.³ He devised the plantation on which he lived to his wife, Mary, during her lifetime, with entail to his son, James, at her death or marriage. He also devised property to his daughter Margaret Wortham, to his son John, and to his son Robert, then a minor. He appointed his wife, Mary, William Wortham, and his son, John Rutherford, as executors and Mary Rutherford qualified as executrix.

John RUTHERFORD and Mary ATKINSON were married about 1724 in Essex Co., VA.³ Mary ATKINSON signed a will on 9 September 1749 in Essex Co., VA.³ She devised to her three sons and her daughters, Agatha and Elizabeth. James and Agatha Boulware presented the will.
She died before 20 March 1753 in Essex Co., VA.³ Will proven for name at place on date.³
