96. Jesse RUTHERFORD35 was born in 1773 in Wythe Co., VA.15,35 Was Fincastle Co., VA. He was living in 1798 in Lincoln Co., KY. He was paid for a wolf scalp. He died after June 1854 in Fayette Co., KY.35 In the 1810, 1820, and 1850 census Jesse was reported to be living in Fayette County, Kentucky. The 1820 census lists the Jessee Rutherford family with three males under twenty-six years of age and six females under the age of twenty-six. In the 1850 census he reports his age as seventy seven and his place of birth as Virginia. He received 80 acres of land in 1851. In a statement made October 17, 1850 in Fayette County, Kentucky he says that he had been drafted into service in Lexington, Kentucky about January 1, 1813. He served in the Company of Captain Abram S. Drake. His term of service was for sixty days and he was discharged at Urbana, Ohio . He made an application for a pension June 15, 1854 in Fayette County , Kentucky. Then he said he volunteered for service April 1, 1813 for a term of six months, and that he served in the company under Captain Thomas Lewis in the Regiment of Kentucky Volunteers. He was discharged September 22, 1813. He was a member of the 13th regiment of the Kentucky Militia during the War of 1812. He was captured by Indians May 5, 1813 and made his escape June 10, 1813 according to a record in the National Archives. One published account of his escape states that "he made his escape by slaying the Indian who guarded him, while washing hominy some distance from the wigwams. He was without food and unarmed, and after fourteen days of wandering and starving, was finally picked up in an almost dying condition by a white scout and carried to the settlements.
