Witnesseth that for and in consideration of the sum of forty five dollars to me in hand paid or promised to be paid the said Mark Monroe hath bargained and sold unto the said George Clapp one lot of land containing one fourth of an acre be the same ******* lying and joining the town property of Maynardville and bounded as follows, to wit: Beginning on a rock the corner of John Robertson’s & James O. Berry’s lot, thence running with the said James O. Berry’s line northwardly to P. L. Chesney’s corner, thence with his line eastwardly to a stake near the branch, thence with said line southwardly to the public square, the town property of Maynardville, thence with the line of said property westwardly to the beginning, to have and to hold the same I covenant with the said George Clapp that I am lawfully seized of said lot, have a good right to sell and convey the same, that the same is unencumbered and further that I warrant and forever defend the title to the same, against the lawful claims, title & demands of all persons whatever. Smith This indenture made and entered into this 5th day of January 1863 Eighteen Hundred and Sixty Three by and between George Clapp of the one part and John A. Smith of the other part both of the County of Union and State of Tennessee Witnesseth that for and in consideration of the sum of one hundred and fifty dollars to me in hand paid, the receipt whereof, is hereby acknowledged. The said George Clapp hath bargained and sold unto the said John A. Smith one lot of land containing one fourth of an acre be the same more or less lying and being in the town of Maynardville and bounded as follows: to wit, beginning on a rock, the corner of John Robertson & James O. Berry’s lots, thence running said Jas. O. Berry’s line northwardly to John A. Cleveland’s Corner, thence with his line easterly to a stake near the branch, thence with said line southwardly to the public square the town property of Maynardville, thence with the line of said property westwardly to the beginning to have and to hold the same I covenant with the said John A. Cleveland This indenture made and entered into this the 1st day of November in the year eighteen hundred and sixty three between George Clapp of the County of Union in the State of Tennessee of the first part and John A. Cleveland of the County and State aforesaid of the other part. Witnesseth that the said George Clapp for and in consideration of the sum of three hundred dollars to him in hand paid by the said John A. Cleveland the receipt whereof is hereby acknowledged, hath and by there presents doth grant bargain sell alien enfee of & convey and con***** unto the said John A. Cleveland certain house and lot in the town of Maynardville in the county and state aforesaid and known in the plat of said town as lot no. 45 and bounded as follows: viz. beginning on the north corner of lot no 40 running thence with Union Street to Back Street to a lot no. 46 thence with the line of said lot to the corner of lot no. 40 thence with the line of said lot to the beginning containing one fourth of an acre more or less, to have and to hold the same unto the said John A. Cleveland, his heirs and assigns forever together with all and singular the henedituments and appurtenances thereunto belonging to the said George Clapp do further covenant with the said John A. Cleveland that I am lawfully seized of and possessed wit the same and that I have a good right to sell and convey the same. I furthermore bind myself, my heirs and assigns forever to defend the title to the said lot against the lawful claim or title of any person or persons whatever. He deeded lot to John A. Cleveland on 10 November 1863 in Maynardville, Union Co., TN. Deed George Clapp to John A. Cleveland This indenture made and entered into this 12th day of November in the year eighteen hundred and sixty three between George Clapp of the County of Union in the State of Tennessee of the first part and John A. Cleveland of County and State aforesaid of the other part. Witnesseth that the said George Clapp for and in consideration of three hundred to him in hand paid by the said John A. Cleveland the receipt thereof is hereby acknowledged hath and by there presents doth grant, bargain, sell, alein ******* convey and confirm unto the said John A. Cleveland certain house and lot in the town of Maynardville in the County and State aforesaid and known in the plat of said town as lot No. 45 and bounded as follows viz, Beginning on the north corner of lot No. 40 running thence with Union Street to Back Street to lot No. 46, thence with the line of said lot to the corner of lot No. 40, thence with the line of said lot to the beginning containing one fourth of an acre more or less to have and to hold the same unto the said John A. Cleveland, his heirs and assigns forever together with all and singular the heredetrements and appurtenances, these unto belonging. I, the said George Clapp do further convey ??? with the said James A. Cleveland that I am lawfully seized of and possessed with the same and that I have a good right to sell and convey the same I further bind myself, my heirs and assigns forever to defend the title to the said lot against the lawful claims on title of every person or persons with even either in law or equity. Cox deed to George Clapp 10 acres This indenture made and entered into this the tenth 10th day of June one thousand eight hundred and sixty five between George Clapp of the County of Union and state of Tennessee of the one part and Samuel J. Cox of the County and State aforesaid of the other part. Witnesseth that the said Samuel J. Cox for and in consideration of the sum of one hundred dollars to him in hand paid the receipt whereof is hereby acknowledged hath and by these presents doth bargain, grant, sell and confirm unto the said George Clapp, his heirs and assigns forever a certain tract or parcel of land lying and being in the County of Union and State of Tennessee lying on the south side of Hinds Ridge bounded as follows: Beginning at a chestnut tree on the top of said Ridge thence south with Huddleston line to John Sharp’s thence with said Sharp’s line to the top of said ridge, thence with said top to the beginning. Estimated to contain ten acres more or less to have and to hold the same to the said George Clapp, his heirs and assigns to his and their use forever and to the said Samuel J. Cox covenant with the said George Clapp his heirs and assigns that I am lawfully seized in fee of the premises that they are free from all encumbrances that I have a good right to sell the same as aforesaid and that I will warrant and defend the same to said George Clapp, his heirs and assigns against the lawful claims and demands of all persons in testimony whereof I the said Samuel J. Cox have hereunto set my hand and seal this 10th day of June A. D. 1865. Signed S. J. Cox (seal) Witness: Calvin Monroe Deed George Clapp and wife Ann to Coram Acuff George Clapp and wife Ann Clapp of Maynardville, Tennessee hereby sell and convey to Coram Acuff for the consideration of eighty in hand paid a peace or parcel of land lying in Union County Tennessee adjoining the town of Maynardville containing ½ acres. Beginning on a stake on Academy Street opposite the northeast corner of the Huddleston Brick property thence northward with said street four poles and 11 ½ feet to A. L. Leinarts corner, thence eastward 17 ½ poles to A. L. Leinarts & George Clapp’s corner in W. G. Monroe’s line, thence southward with George Clapp’s & W. G. Monroe’s line four poles & 11 ½ feet to a stake thence direct to the beginning corner. We covenant the said land is unencumbered & we will always warrant & defend the title to said Coram Acuff, his heirs & assigns, witness our signatures this 25th day of April 1871. Trust Deed Book A, page 198 and 199 Know all men by these present that I George Clapp have this day bargained and sold, and do hereby transfer and convey to W. D. L. Kincaid for the sum of one dollar to me in hand paid the receipt whereof is hereby acknowledged, and the other considerations hereinafter mentioned a certain light Bay mule about 15 hands high, about 4 years old and known as the mule that the said George Clapp bought of E. M. Ledgerwood, to have and to hold the same to the said M. D. L. Kincaid, his heirs and assigns & representatives. I do covenant with the same M. D. L. Kincaid, that I am lawfully possessed of said property. But this deed is made for the following purposes and no other, that is to say, I am indebted to A. L. Leinast, late guardian for the use of Stephen Frost present guardian of Sterling Warwick in the sum of eighty-seven dollars and ninety cents by note upon which I confessed judgment before J. F. Huddleston Esquire on the 1st day of January 1877 for eighty-seven dollars and ninety cents, and am desirous to secure and make certain the payment of the same. Now if I should pay the said debt on or before the 1st day of September 1877 then this deed be null and void, but if I should not, then the said M. D. L. Kincaid can, as trustee, after giving 10 days notice in writing at the court house door of said county & two other places in said county at my expense shall expose the said property to public sale and sell it to the highest bidder for cash and appropriate the proceeds, first to the payment of necessary expenses and costs: secondly to the satisfaction of said debt of eighty-seven dollars and ninety cents and interest thereon: and lastly, pay the balance if any there is to me. J. Carr’s tract on the top of hinds ridge running thence south with said Carr line to John Sharp’s land thence eastwardly with the line of said Sharp line to black oak on said Sharp’s line that runs nearly north & south thence northwardly with said Sharp line to the top of said ridge to the beginning containing ten acres more or less together with all and singular the hereditaments and appurtenances to have and to hold said premises as described with the appurtenances unto the said party of the second part and to his heirs and assigns forever and the said parties of the first part, their heirs, executors, administrators and assigns do covenant, grant, bargain and agree to and with the said party of the second part his heirs and assigns that at the time of the ensealing and delivery of these presents they are well seized of the above granted premise in fee simple that they are free from all encumbrances whatever and that they will and their heirs, executors, administrators and assigns shall warrant and defend the same against all lawful claims whatsoever in witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written.
