58. William RUTHERFORD was born on 4 March 1784 in Milledgeville, Baldwin Co., GA. He signed a will about 1862 in Monroe Co., GA. I, Williams Rutherford well knowing that all men must die and having now lived over the three score and ten years allotted to man felt the importance of preparing for death. I do therefore constitute the following items my last will and testament hereby revoking all my will previously made.
Item 1st I desire my wife Elizabeth Wallace Rutherford shall pay all of my debt out of the growing crop or on hand at my death, hereby constituting her sole executrix, and without imposing upon her the common obligation of going to court for orders or other directions having full confidence in her integrity, I give to sell and to buy to exchange & other wise manage as shall seem good and fair to her. But I desire my will proven & recorded in the proper office for the inspection of all concerned.
Item 2nd In providing for my wife Elizabeth W. Rutherford I give her my residence in Culloden including 60 acres of land 'more or less' bounded North by the road leading out of Culloden to Logtown on the line between my lands and Jackson Brown on original land line thence South with the fence on said original land line to a cherry tree marked on the east side thus WR standing within the fence road thence a direct line running a little south of east of the road passing out of Culloden to Flint River & to a corner opposite the McIntosh lot & which will be found to be a china tree marked WR and which bounding line will more particular be pointed out by a fence running from said china tree to the said cherry marked WR. From the china tree turn up the road toward Culloden to the College lot-there turn with the street between said college lot & my residence to the street first named running out to Logtown. And I further give my wife with the above premises a fine bedstead also the trunk and her favorite bureau and dressing glass all of which I mean her to have for a Christmas present.
Item 3rd Whereas I revised title to certain property by inter marriage with Elizabeth my wife consisting of cash, notes, stock and certain negros viz Bryant, Davy Essy Lizzie & Mary, and being desireous to give my wife mainly the property I got by her I now proceed to give her Bryant, Essy with her increase, Albrea(?), and Fannie also Lizzie and whereas I appropriated her negro girl Mary and her other property to the payment of my debts and to my estate, I do hereby give my said wife Elizabeth certain negroes (pointed out at the time I used her property) as an equivelent: Big Lilla and her four children, Louisa, Caroline, Bacon and Grace, also Jane daughter of Lucinda which were children together with Tom the son of Suzy, and Eliza daughter of Hannah. Now whereas Lilla and Caroline are both dead I give now (according to my engagement) the eight named above with their increase
He died on 17 January 1863 in Culloden, Monroe Co., GA.
