148. Samuel RUTHERFORD was born on 15 February 1813 in Milledgeville, Baldwin Co., GA. He owned on 8 November 1848 in Crawford Co., GA. The following appeaared in the Georgia Journal on Nov 8, 1848. The Plantation referred to was Elmwood. VALUABLE PLANTATION FOR SALE. I desire to sell my home place in the northern part of Crawford County--the place contains about 1200 acres of rich and productive land, mixed post Oak and Hickory, with considerable lime in the soil. There are 500 acres cleared. I desier to sell because I wish to concentrate all my force and attention on a larger plantation below, on the Flint River. Samuel Rutherford. WILL OF SAMUEL RUTHERFORD, LOCKWOOD STATE OF GEORGIA Whereas the times are troublous and the future CRAWFORD COUNTY uncertain, and blessed with some of this world's MARCH 1865 goods which it is necessary to be protected & taken care of & properly distributed in case of my death being aware my health is very precarious. Now therefore I, Samuel Rutherford of the county and state aforesaid being of sound mind do make and ordain this as my last will & testament hereby revoking and making void all other former wills or testaments. Having given to my only & dearly beloved son Williams Rutherford Boys William or Bill, Julius and Marby, a fine gold watch & a horse Ball and buggy, and boy Julius having lately died, now to save my son from that loss I do give him & bequeath him my gold society key and gold stud collar button, also bed quilt made by my mother for my youngest brother James, now dead. To my eldest daughter Eliza having given her my dear wife's watch I ratify that gift. I also give and bequeath her girl Bashy, Mammy's eldest daughter & child also boy Ishmael. Woman Matilda & her two children Victoria and Felix. Also her own wearing clothes, one feather bed and mattress now in her room and her bedstead and one pair of linen sheets and bolster cases, pillow slips and one pair counterpane cotton sheets and pillow & bolster slips to match her pair also her blankets, two bed quilts, bureau and other room furniture & her mother's large (?) and Saratoga trunk. And this is and shall be all & no more of any legacy or property I may leave behind me. And I feel a clear conscience in acting and not bequeathing her any more. To my dearest baby Mary Jones or Molly, I give & bequeath old Kearney, Mammy or Eliza his wife, Eaton their son & Kearney their son & Alice & Margaret or Gransy Peg their youngest daughters & Mammy's increase. Also Laura her nurse and Dora her child & Laura's increase. Also my watch. But my son may exchange watches if he desires with her. I constitute and appoint my son Williams Rutherford my sole executor leaving my whole property in his hands with power & authority to act in any manner with my estate he may think best for the interest of my estate. I desire & will that he shall settle & pay all my debts as soon as possible or convenient. After my estate is settled up by debts being paid & the above legacies are paid out I give and bequeath unto him two thirds of all the remainder of my estate or of any legacies I may receive from any source to have and to hold & will & bequeath in his own right & title. But should he be killed in battle or die and neglect to make a will then I will his share of my property or estate to his sister Mary Jones or Mollie. To my daughter Mary Jones or Mollie besides the legacies in this will I give & bequeath the remaining one third of my estate or property or legacies after all my debts are settled or paid. I constitute & appoint my son hold as trustee all the property and legacies left to my daughter Mary Jones or Mollie for her sole use & benefit. I hereby declare & will that none of her property is or shall be liable to any debts contracted or hereafter may be contracted by her husband & if in the providence of God she Mary Jones or Mollie should die without a child or children then her property & legacies shall revert to & I will & bequeath to my son Williams Rutherford. If in the providence of God my son Williams Rutherford dies or gets killed before he is able to take charge of my estate & execute my will then I constitute & appoint my brother Williams Rutherford of Athens & my brother-in-law James Randall Jones of Alabama my executors to carry out & execute this my last will & testament unless my son should make other arrangements himself. I will & desire to be buried in that vacant space by the side of my mother near Milledgeville & that there be a good iron railing & proper marble tombstones put around & over my wife & children in Columbus.
