Deed from Abraham Cortner to the Trustees of the New Market Presbyterian Church. 19 Oct 1839 Clark Co., IN Deed Book #32, page 547 This indenture made the 19th of October in the year of our Lord one thousand eight hundred and thirty nine between Abraham Cortner of the County of Clark and State of Indiana of the one part and Daniel Cortner, George R. Stith, John Covert, John Handlen and Levi Amick, trustees appointed in conformity with the statutes in such case made and provided, and their successors in office in trustee for the uses and purposes hereinafter mentioned, all of the county and Sate aforesaid of the other part, Witnesseth, that the said Abraham Cortner, for and in consideration of the sum of twenty dollars to him in hand paid the receipt whereof he doth hereby acknowledge, hath granted, bargained, sold, conveyed and confirmed, and doth by these presents, grant, bargain, sell, convey, and confirm unto then the said Daniel Cortner, George R. Stith, John Covert, John Handlen and Levi Amick and their successors, trustees as aforesaid in trust for the uses and purposes hereinafter mentioned and declared, all the estate, right, title, interest, claim and demand to him the said Abraham Cortner in and to a certain tract or parcel of land lying and being in the County of Clark aforesaid, being part of the Survey which is designated in plat of the Illinois Grant by the number one hundred and ninety-five, and bounded as follows, to wit: Beginning at a stone near the meeting house and running south 49 deg. West 57 poles to a stone; thence north 41 deg. West 52 ½ poles to a stone; thence north 49 deg. East 37 poles to a stone; thence south 49 deg. East 20 poles to a stone; thence north 41 deg. East 17 ½ poles to the beginning, containing 14 acres and 55 poles, together with all the buildings, improvements and appurtenances to the said premises belonging, or in any wise appertaining, to have and to hold all the above described tract or parcel of land with all the appurtenances unto them the above named trustees and their success in office forever, in trust for the exclusive use and benefit of the Mount Vernon Presbyterian Church and that the said trustees will from time to time erect or permit to be erected upon the said land any house or house for public worship, or for any other purpose connected with the interest or convenience of the said church, and permit the members of the said church from time to time and at all times forever, to occupy, use and enjoy the same, and further that the present members of said church as at present organized and their successors connected with that system of the Presbyterian Church commonly called the Constitutional or New Party School shall have the exclusive right to occupy and enjoy the said premises with the appurtenances and to direct their sole and only proper use and benefit and further that if at any time hereafter a majority of the members of said church for the time being shall deem it to be for their interest to sell or otherwise dispose of said premises the said trustees or their successors or the survivors of them shall sell and convey the same or a majority of the members of said church shall order and direct and the said trustees shall in all respects exercise the powers hereby vested in them in such manner as shall best promote the interest of the members of said church for the time being and in conformity with the laws of the State of Indiana, and the said Abraham Cortner doth by these presents covenant with the said trustees that he will warrant and defend the said premises against the lawful claim of himself and his heirs, and also against the lawful claim or claims of all other persons whatsoever, and Elizabeth Cortner the wife of said Abraham Cortner doth hereby relinquish all her right and title of Dower in and to the premises aforesaid, In testimony whereof, the said Abraham Cortner and Elizabeth Cortner, his wife, have hereunto set their hands and seals the day and year first above written.
